Maximum jail sentences are:

1. Drunk driving, first offense – misdemeanor – 93 days in county jail.

2. Drunk driving, second offense – misdemeanor – one year in county jail, minimum five days.

3. Drunk driving, third offense – felony – five years in State prison, minimum 30 days in county jail.

4. Drunk driving causing a serious impairment of a body function – felony – five years in State prison.

5. Drunk driving causing death – felony – 15 years in State prison.

6. Drunk driving causing death of a police officer, fire fighter or emergency response personnel – felony – 20 years in State prison.

7. Child endangerment – drunk driving with passenger less than 16 years of age – misdemeanor – one year in county jail, minimum five days.

8. Child endangerment – drunk driving with passenger less than 16 years of age, second offense – felony – five years in State prison, minimum 30 days in county jail.

9. Knowingly allowing another person to operate a motor vehicle while drunk – misdemeanor – 93 days in county jail.

10. Knowingly allowing another person to operate a motor vehicle while drunk resulting in death – felony – five years in State prison.

11. Knowingly allowing another person to operate a motor vehicle while drunk causing a serious impairment of a body function – felony – two years in State prison.

12. Drunk driving under 21 years of age, BAC less than .08, first offense – misdemeanor – no jail unless violate probation.

13. Drunk driving under 21 years of age, BAC less than .08, second offense – misdemeanor – 93 days in county jail.

14. Drunk driving under 21 years of age, BAC less than .08, child endangerment – misdemeanor – 93 days in county jail.

15. Drunk driving under 21 years of age, BAC less than .08, child endangerment, second offense – misdemeanor – one year in county jail, minimum five days.

In addition to the penalties listed above, the court may also order that the vehicle involved be immobilized so that it may not be used by the offender or any other person. Under certain circumstances, vehicle immobilization is mandatory. Vehicle forfeiture is also a possible sanction for certain offenses.

In addition to the sanctions imposed by the court, the Secretary of State will take action on the offender’s driving privileges. For most people charged with a second offense or a felony drunk driving charge, if convicted, their license will be revoked by the Secretary of State, i.e., no restricted driving privileges at all.
